TERMS AND CONDITIONS OF HIRE

•  Definitions

The following definitions apply for the Terms and Conditions for Aussie Dollar Campervan Rentals Tasmania.

Hirer is AUSP Pty Ltd Trading as Aussie Dollar Campervan Hirer Tasmania acn 122709022, 94 Kennedy Drive Cambridge , Tasmania Australia Ph 62485488 fax 62485835. Agreement is this agreement once signed.

Hiree is the person entering into the agreement, may also be referred to as "you."

$ refers to Australian currency only.

Goods and Services Tax (GST) is any tax payable by Hirer arising from a supply except for rental.

The vehicle is the campervan, motor home or any other vehicle owned by the hirer and hired to the hiree under the Agreement.

Insurance Excess is the part the insurance does not cover - Security Deposit/Bond is an amount held for things such as refueling, traffic infringements etc

The travel agent is referred to as The Agent.

•  Depot Hours

Seven days a week 8.00am - 5.00pm except Christmas Day (25 th December) all branches closed.

•  Reservation

The hirer shall confirm all reservations upon receiving and receipting a deposit of $200.00. The reservation shall be conditional upon the Hiree paying the balance of all monies quoted by the Hirer under the Agreement including all Rental and Insurance either prior to or on collection of vehicle.

•  Rental

Rental includes stamp duty, GST, unlimited kilometers, first bottle of gas and 24 hour Roadside Assist (RACT). Road atlas and camping guides are provided and insurance is included subject to the payment of the excess by the hiree on any claim. All fuel, LP gas (after first bottle), the vehicle security deposit, relocation fees and additional items for hire are not included in the rental rate.

•  Insurance

Vehicles are insured against damage but excluding damage to windscreen, underbody, overhead and tires which shall be replaced or repaired at the expense of the hiree at all times. All insurance claims are subject to an excess and any excess must be paid by the hiree with in seven (7) days of any incident giving rise to an insurance claim. The hiree is liable for any damage caused by abuse or misuse of the vehicle or arising from any circumstances which could have been reasonably foreseen by the hiree, which causes damage to the vehicle or any third party. Personal injury is insured under the statutory third party insurance and cover is limited to the terms of that insurance. The hiree shall reimburse the hirer for any loss arising from a vitation of any insurance policy due to the acts or omissions of the hiree. No personal property of the hiree is insured at any time by the hirer.

•  Area of use

Vehicles are restricted to Tasmanian sealed roads unless prior approval granted.

•  Road Side Assist. 131111

Road Side Assist (RACT) is available 24hrs a day seven days a week. Please call 131111 for on road service. Any problems associated with the vehicle or equipment failure must be reported as soon as possible on 62485488 or with in 24hours in order to give the hirer the opportunity to rectify the problem. Failure to do so will compromise any claims for compensation. We do not accept liability for claims submitted after this period.

8.) Security Deposit/Bond

The hirer shall hold a $1000.00 security deposit in the form of a manual credit card swipe which is destroyed when the van is returned in a clean, undamaged condition and free of traffic infringements. Notification of infringement takes up to 21 days after return.

9.) Insurance excess

Standard comprehensive insurance is included in the daily rental rate, a standard vehicle security deposit of $2500.00 applies. On collection of the vehicle the hiree agrees to leave a vehicle security deposit and authorizes the hirer to deduct from the security deposit any amounts due by them to the hirer arising out of the agreement. The vehicle Security Deposit can be reduced and this is determined by which excess reduction option is selected.

OPTION 1 AU$20.00 per day (maximum charge $1000.00) - the excess is reduced to $1000.00 which is held as the hiree's security deposit. The $1000.00 is taken as an authorization on your credit card.

OPTION 2 AU$30.00 per day (maximum charge $1500.00) - the excess is reduced to $400.00 with a security deposit/bond of $1000.00 held as an authorization on your credit card.

10.)Drivers Licence

A valid full drivers licence issued in Australia is required or in the case of an international driver, a valid licence from the country of origin or an international drivers permit must be produced for all drivers. No driver under the age of 21 years shall drive the vehicle at any time and drivers over the age of 70 require a medical certificate verifying the hirees ability to drive the vehicle. Under no circumstances is a driver other than a person nominated by the hiree and approved by the hirer to drive the vehicle.

11.)Traffic Infringements

Under absolutely no circumstances is the vehicle to be driven by any person over .05 alcohol limit or under the influence of drugs. All traffic infringements notices, fines, other statutory penalties and unreported damage to third party property incurred while the vehicle is in the possession of the Hiree shall be paid for by the Hiree. A $55 administration fee will apply to all traffic infringements processed by the hirer

12.) Mechanical Breakdowns of Vehicles

In the event of a mechanical breakdown, the Hiree may authorize repairs not exceeding $100.00 which will be refunded by the hirer upon return of the vehicle with a tax invoice and receipt. The Hiree must not authorize any repairs exceeding $100.00 with out the consent of the Hirer

•  Replacement of Vehicles

Should a Vehicle require a major repair with no likelihood of proceeding within a reasonable time, the hirer shall use its best endeavors to provide a similar replacement Vehicle, but if it is impractical or not commercially expedient, the Hirer may elect, at its discretion, not provide a replacement Vehicle but shall refund any unused Rental to the Hiree. If the breakdown is caused by any breach of this agreement by the Hiree or the Hiree's abuse or misuse of the Vehicle, the Hiree shall pay the cost of the repairs and will not be entitled to a replacement Vehicle or any refund under this agreement.

•  Keys

The Hiree is responsible for the keys to the Vehicle. In the event that the keys are locked in the Vehicle or lost or broken the Hiree shall be required to pay any cost associated with the retrieval of, replacement of or repair of the keys. This includes the RACT call out fee if required.

•  Money Currency and Goods and Services Tax

All reference to monitory amounts are expressed in Australian Dollars and except for Rental are exclusive of Goods and Services Tax. Should the hirer be liable for the payment of any Goods and Services Tax for a supply under the terms of the agreement except for Rental, the Hiree shall pay such amount to the Hirer upon being provided with a Tax invoice.

•  Law

The agreement shall be governed by and construed in accordance with the laws of the State of Tasmania and the parties agree to submit to the non-exclusive jurisdiction of the courts of this state and courts having appellant jurisdiction therefrom.

Cancellation Policy:

If cancelled the following fees apply:
30 days and beyond before pick up - $55.00 cancellation fee
29 days to 7 days before pick up - $200.00 (deposit amount)
6 days to 0 days before pick up and including no show - 50% of gross rental with a minimum of $250.00

If vehicle is returned early no refund is available.
